APPEAL IN MOTION - MENDHAM IN MIND
On behalf of our community, the Mendham Alliance for Preservation and Conservation (MAPC), in partnership with the New Jersey Highlands Coalition, has officially filed a legal appeal challenging the Mendham Borough Joint Land Use Board’s (JLUB) approval of the proposed 75-unit, 5-story apartment complex and luxury auto facility behind Kings Market.
This appeal—filed as a Complaint in Lieu of Prerogative Writs—was submitted in Morris County Superior Court on April 30th and can be downloaded by clicking this link. It is based on substantial procedural and environmental concerns, and represents a major step in the effort to ensure any development in Mendham reflects responsible planning and legal compliance.
WHAT THE APPEAL CHALLENGES
-
Incomplete and inadequate stormwater management plan
-
Lack of proper ecological and environmental review
-
Serious traffic and pedestrian safety issues
-
A flawed and restrictive public hearing process
-
Approval granted with over 20 unresolved legal and technical conditions
WHY THIS MATTERS
Protecting the Raritan River Headwaters
The headwaters of the Raritan River are one of the most valuable natural resources in New Jersey, providing clean drinking water to millions. The MAPC, Raritan Headwaters Association and NJ Highlands Coalition support redevelopment projects in downtown areas that will result in improvements to stormwater management, wastewater treatment, and other environmental benefits. However, oversized development increases stormwater runoff, pollution, and erosion, endangering water quality and creating long-term restoration challenges.

The Raritan Headwaters Association, an environmental leader in watershed protection, will support the MAPC appeal to safeguard these vital water resources and ensure compliance with environmental laws. www.raritanheadwaters.org/
The NJ Highlands Coalition, dedicated to preserving the natural and cultural resources of New Jersey’s Highlands, is playing a crucial role in ensuring that this overdevelopment does not set a dangerous land use precedent for future planning decisions. www.njhighlandscoalition.org
Preventing Overburdened Infrastructure & Safety Risks
· Traffic & Pedestrian Safety: The area cannot safely handle the increased on-site traffic burden.
· School Overcrowding: Additional residential density puts stress on our local schools.
· Emergency Services Strain: Increased population raises demands on police, fire, and EMS, potentially delaying response times.
